Declaration of Trust 1988"},"content":{"rendered":"\n<h2 class=\"wp-block-heading\">Custodian Trustee Declaration<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">This page brings together key correspondence with the Charity Commission from 1987\u20131989, which sets out the requirements for the sale of the Old School and the construction of a new village hall.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Charity Commission made clear that:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>the Parish Council, as custodian trustee, held the legal title to the property but had no role in the administration of the charity<\/li>\n\n\n\n<li>decisions about the sale of charity property were matters for the Committee of Management (the managing trustees)<\/li>\n\n\n\n<li>the proposed sale required both:\n<ul class=\"wp-block-list\">\n<li>approval by a meeting of inhabitants (as required by the 1976 governing document)<\/li>\n\n\n\n<li>a formal Order of the Charity Commission<\/li>\n<\/ul>\n<\/li>\n\n\n\n<li>before granting such an Order, the Commission would require a report from a surveyor acting exclusively in the interests of the charity<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">The Commission also requested confirmation that:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"has-tertiary-background-color has-background wp-block-paragraph\">\u201cthe new hall will be held on the trusts contained in the conveyance of 20 October 1976\u201d<\/p>\n<\/blockquote>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h2 class=\"wp-block-heading\">Declaration of Trust (1988\u20131989)<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">In response to these requirements, correspondence from 1988 confirms that:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>the inhabitants of Mulbarton had approved the proposed sale<\/li>\n\n\n\n<li>the managing trustees were in agreement<\/li>\n\n\n\n<li>a loan was being arranged to fund construction<\/li>\n\n\n\n<li>and that the new hall:<\/li>\n<\/ul>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"has-tertiary-background-color has-background wp-block-paragraph\">\u201cwill be held on the trusts contained in the conveyance\u201d<\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">A further statement to the same effect appears in subsequent correspondence, confirming that:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"has-tertiary-background-color has-background wp-block-paragraph\">\u201cthe new Village Hall\u2026 will be administered by the management committee and held on the trusts as before\u201d<\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">These written confirmations formed part of the material relied upon by the Charity Commission in issuing the court orders required to:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>authorise the sale of the existing hall<\/li>\n\n\n\n<li>enable borrowing for construction of the new hall<\/li>\n<\/ul>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h2 class=\"wp-block-heading\">Status of the Declaration<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The 1988\u20131989 correspondence demonstrates that:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>the intention was clearly recorded that the new hall would be held on the same trusts as the 1976 conveyance<\/li>\n\n\n\n<li>this intention was communicated to, and accepted by, the Charity Commission as part of the approval process<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">However, the documents do not define the precise physical extent of the land to which those trusts applied.
