Sealed Court Orders 1988"},"content":{"rendered":"\n<p class=\"wp-block-paragraph\">Two court orders were sealed in relation to the transition from the Old School Village Hall to the new site.<\/p>\n\n\n\n<div class=\"wp-block-buttons is-content-justification-center is-layout-flex wp-container-core-buttons-is-layout-20959078 wp-block-buttons-is-layout-flex\">\n<div class=\"wp-block-button\"><a class=\"wp-block-button__link wp-element-button\" href=\"https:\/\/mulbartonvh.uk\/wp-content\/uploads\/2024\/08\/Court-Orders-Redacted.pdf\">Court Orders September 1988<\/a><\/div>\n<\/div>\n\n\n\n\n\n\n<p class=\"wp-block-paragraph\">These orders were made on the basis of:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>the Custodian Trustee\u2019s signed declaration<\/li>\n\n\n\n<li>the Managing Trustees\u2019 Form 14 submission<\/li>\n\n\n\n<li>the Surveyor&#8217;s charity report<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">The first order authorised the&nbsp;<strong>sale of the existing charity property, on conditions determined by trustees and their advisors<\/strong>.<br>The second authorised the <strong>use of that property as security for borrowing<\/strong>, to fund construction of the new hall.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h2 class=\"wp-block-heading\">Effect of the Orders<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The orders lifted the usual legal restrictions on the disposal and mortgaging of charity property, subject to conditions.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">They record that:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>the sale proceeds were to be applied to the provision of a new village hall<\/li>\n\n\n\n<li>the charity would continue to operate under the trusts established in the 1976 governing document<\/li>\n\n\n\n<li>the arrangements had been reviewed and certified by an independent Surveyor, as being in the interests of the charity<\/li>\n\n\n\n<li>power was given to managing trustees to determine <strong>conditions<\/strong> of sale \u201cin the interests of the Charity\u201d<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">The borrowing order also records that the new community centre was to be constructed <strong>\u201con land belonging to the charity.\u201d<\/strong><\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h2 class=\"wp-block-heading\">Implementation<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The orders were acted upon immediately. Payments to contractors followed within days, and the sale of the Old School completed shortly afterwards.
